A Hum Music, LLC Agreement to Participate with Consent and Waiver of Liability: I, the minor child’s parent/guardian with legal responsibility for the child or children I am now registering assume full responsibility for said child (children) at all times before, during, and after participating in a Music for Aardvarks class offered by A Hum Music, LLC in Bergen County, New Jersey. I fully accept this program involves music and movement with both children and adults and I am responsible for intervening if my child is acting in a way in which s/he can physically hurt himself or another participant before, during, and after class. I, the minor child’s parent/guardian agree A Hum Music, LLC and affiliated companies, representatives, instructors, musicians, owners and lessors of the premises are not responsible for any injury (or loss of property) to any person suffered while in any way involved in A Hum Music, LLC activities for any reason whatsoever. Parent participation in class is expected. Out of respect to fellow class participants, instructors, and children, adult conversations must be kept to a minimum and focus must be on the children. Food of any kind is not permitted in the studios. Two make-up classes are allowed per semester. Make-up requests must be done at least 48 hours in advance using the makeup scheduler through http://www.ahummusic.com or http://www.mainstreetsites.com A Hum Music, LLC reserves the right to cancel or change a class day and or time at it’s discretion. On behalf of myself and that of my minor child for which I am the parent or guardian, I give A Hum Music, LLC or its designee the irrevocable right to take and use my and my child’s picture, likeness, photograph, and/or video in all forms and media and for any advertising, promotional, internet (website and facebook), and publicity purposes. I waive any rights I may have in connection with any use of the material, including any right to inspect or approve the finished use, including any written copy that may be created in connection with such use. If I choose to withdraw from classes, I acknowledge the current cancelation and refund policies of A Hum Music, LLC that a refund less a $35 registration fee is possible until the start date of the semester, and no refunds are available after the start date of the semester for which I registered.

The World Health Organization has declared the novel Coronavirus (COVID-19) a worldwide pandemic. Due to its capacity to transmit from person-to-person through respiratory droplets, the government has set recommendations, guidelines, and some prohibitions which A Hum Music, LLC. (the "Organization") adheres to comply.

I have not experienced symptoms that of fever, fatigue, difficulty in breathing, or dry cough or exhibiting any other symptoms relating to COVID-19 or any communicable disease within the last 14 days.

I have not been, nor any member(s) of my household, diagnosed to be infected of COVID-19 virus within the last 14 days.

I am fully and personally responsible for my own safety and actions while and during may participation and I recognize that I may be in any case be at risk of contracting COVID-19.

With full knowledge of the risks involved, I hereby release, waive, discharge the Organization, its board, officers, independent contractors, affiliates, employees, representatives, successors, and assigns from any and all liabilities, claims, demands, actions, and causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, injury, or death, that may be sustained by me related to COVID-19 while participating in any activity while in, on, or around the premises or while using the facilities that may lead to unintentional exposure or harm due to COVID-19.

I agree to indemnify, defend, and hold harmless the Organization from and against any and all costs, expenses, damages, lawsuits, and/or liabilities or claims arising whether directly or indirectly from or related to any and all claims made by or against any of the released party due to injury, loss, or death from or related to COVID-19.

I acknowledge that I have read the foregoing Liability Release Waiver and understand its contents; that I am at least eighteen (18) years old and fully competent to give my consent; That I have been sufficiently informed of the risks involved and give my voluntary consent in agreeing to terms it as my own free act and deed; that I give my voluntary consent in consenting to this Liability Release Waiver as my own free act and deed with full intention to be bound by the same, and free from any inducement or representation.

This waiver will remain effective until laws and mandates relevant to COVID-19 are lifted.
