Liability Waiver for Songbirds Music LLC

COVID-19 ASSUMPTION OF THE RISKS AND WAIVER OF LIABILITY. As a willing participant in Music Together®, Canta y Baila Conmigo®, or any other classes at Songbirds Music LLC my family and I agree to the following:

ASSUMPTION OF THE RISKS: I understand that naturally occurring disease processes (including, but not limited to, the novel coronavirus or COVID-19), may exist in the community, including at Songbirds Music LLC , and present an inherent risk that cannot be eliminated. I acknowledge that, although Songbirds Music LLC r is taking reasonable measures to avoid contact, transmittal, and exposure of disease processes like COVID-19 between people in our classes (including all teachers, and third parties), it is ultimately my own responsibility to ensure that I take appropriate actions to safeguard myself and my child/children, including all adults, and children two or older, wearing masks when arriving to, departing from, or leaving the family "spot" at any time during, class. All family members must stay within their personal area and ensure that personal instruments/props are not shared between families. I understand and agree that as a registered family with Songbirds Music LLC , I am accepting and voluntarily assuming the risk that my child or I may be exposed and become ill as a result of COVID-19 and other diseases.

WAIVER OF LIABILITY: I, on behalf of myself and my children, hereby voluntarily release, forever discharge, and covenant not to sue Songbirds Music LLC  and its owners, managers, contractors, members, employees, agents, and volunteers, or the location owner (“Released Parties”) for any claims that may arise out of or relate in any way to my or my child’s exposure to any communicable disease, including but not limited to the novel coronavirus (COVID-19) or any other accident that may cause harm. In addition, I also assume the inherent risk of being outdoors with my children including but not limited to ticks, bees/yellowjackets, insects, poison ivy, or other outdoor hazards. The claims hereby released include, but are not limited to, claims of negligence against any of the Released Parties.

I HAVE CAREFULLY READ THIS WAIVER AND FULLY UNDERSTAND ITS CONTENTS. BY ENROLLING IN CLASSES AT SONGBIRDS MUSIC LLC , I UNDERSTAND I HAVE GIVEN UP CERTAIN LEGAL RIGHTS AND THAT THIS IS A BINDING LEGAL DOCUMENT.

COVID-19 PROTOCOL (Updated Nov.  2023)

Songbirds Music follows CDC and State of CA guidelines and for COVID-19

-In-person classes may be canceled or moved online at any time

-Vaccinated: masks are optional  Unvaccinated: masks are recommended for anyone over 2

-Sick children and adults must stay home

-No refunds/credit is issued when state or local COVID-19 regulations require in-person classes to be canceled

–>If you/your child tests positive for COVID-19 <–

-Isolate and do not attend class for 5 days from the time of your positive test.

-Once you are are fever-free for 24 hours (without the use of fever-reducing medication) and your symptoms are improving, you may attend class after 5 days with a mask

 -If your symptoms are more severe, isolate for 10 days.

Terms and Conditions

The following Terms and Conditions apply to all Songbirds Music LLC’s  programs as described below, upon completing an online registration or registering manually through the office.

Registration:  You agree to allow Songbirds Music LLC  to accept verbal authorization from you, for additional registrations in the future by phone or email in lieu of an online registration.  By providing your payment information and/or creating a payment profile, you authorize Songbirds Music LLC  to bill you for the class.

Payment of Fees and Acceptance of Policies and Procedures:  New registrations include a one-time, non-refundable admin fee of $20.00. Tuition must be paid by credit card payment, Venmo, or cash. All charges will appear on your credit card statement as being from Songbirds Music.  Providing Songbirds Music LLC with your payment information by phone, email, in-person, or by any other means indicates acceptance of all policies and procedures herein listed.  Attending any Songbirds Music LLC Together classes indicates acceptance of all policies and procedures herein listed. 

➤ Family pricing applies to siblings only. Cousins/nanny shares must register separately.

Sibling Guest Policy: Space-permitting, each enrolled family gets one free class for an older sibling to attend. A $20 guest fee will be charged for each additional class attendance that is not connected to a federal or official school holiday.

Friend Guest Policy: Space-permitting enrolled families may pay a drop-in fee of $35 for a friend to visit a class with you. Friends may not take up a class spot in your absence. Any family attending a class must be registered either as an enrolled family or as a drop-in.

If you are enrolled in one program but switch to a different program after the session begins (for example, switching from Canta y Baila Conmigo^® to Music Together^®), you will be charged a $45 curriculum switch fee. 

Semester Cancellations: No refunds once a session begins. No exceptions. Credit towards a future session may be granted at the discretion of the director in exceptional circumstances.

Class Cancellations: Sometimes classes don’t fill up the way we would like. Songbirds Music LLC  reserves the right to combine or cancel classes due to low enrollment.  Songbirds Music will make every effort to accommodate you and your child in an alternate class at least 5 days prior to your start date. In the event that we are unable to accommodate you, a full refund or credit will be issued. Refunds will not apply if you cancel your enrollment after the session begins. 

Make-up Classes:  Families are entitled to unlimited make-up classes. All makeups/drop-ins must be scheduled online via our Makeup Scheduler so we don’t overcrowd classes. No refunds are given for missed classes. Makeups must be completed by the end date of the current session; makeups do not roll over to future sessions.

Parents’ Responsibility to be aware of Dates and Events:  It is the responsibility of the parent to be aware of all session dates and holidays. Songbirds Music LLC will post all such notices on our website and in the studio. We will send notices/email/text messages home, when appropriate.  It is the parent’s responsibility to regularly check these media to ensure they are informed.  It is the responsibility of the parents to inform Songbirds Music LLC of any address, email, or  telephone number changes. 

Extreme Weather or Unexpected Interruption of Classes:  IfSongbirds Music LLC must cancel classes due to extreme weather or events beyond our control such as power outages, the missed classes will be added on where possible.  No refunds due to these reasons will be given.

Injuries:  Parents, legal guardians of minor students and adult students waive the right to any legal action for any injury sustained atSongbirds Music LLC venues resulting from normal class activity or any other activity conducted by families before, during, or after class time.

Media Release:  Songbirds Music LLC and its business affiliates are hereby granted permission to take photographs and audio-visual recordings of the students in classes and other related events to use in brochures, websites, posters, advertisements, social media, and other promotional materials that Songbirds Music LLC.  Permission is also hereby granted for Songbirds Music LLC to copyright such photographs in its name. If you do not want your child to be photographed please email [email protected] or let your teacher know on the first day of class. 

Privacy:  Songbirds Music LLC does not sell or give personal information to third parties without express consent.  Songbirds Music LLC will use your personal contact information for:

• Delivering News via phone, email, and mail.

• Reminders of important dates or schedule updates  via phone, email, and mail

• Promotions that Songbirds Music LLC  may run from time to time

• Promotions that Songbirds Music LLC  may receive from community and business partners from time to time

The above items are subscribed to by default upon registration.  For phone and email communication students may opt out at any time using the methods provided in those systems. 

By enrolling in a Music Together class at Songbirds Music LLC, a licensed Music Together center, you agree that any information you provide will be shared with Music Together Worldwide (MTW). For information about how MTW uses and stores your personal information, we encourage you to review the Music Together Worldwide Privacy Policy.

Policy and Procedure Changes:  These Policies and Procedures are subject to change at any time, and the most recent version of them will be posted to our website.  All registered parties agree to the terms herein, as well as changes to these policies when posted to the website by signing and/or registering and re-registering by phone.
